Convicted murderer sues prison for running out of waffles

Iatonda Taylor, who was jailed for killing his brother with a kitchen knife, has filed a lawsuit because he was frustrated with the prison food.

According to MLive, Taylor became upset when the prison ran out of waffles for breakfast and had to serve peanut butter and jelly sandwiches instead. At another time, peach cobbler was served instead of the promised bread pudding, and another instance saw scrambled eggs replacing the grilled cheese sandwiches on the menu.

Taylor’s suit against Aramark, which was the food service provider to the state Department of Corrections, alleges that his constitutional rights were violated because the state of the food put him in danger. He alleged that not only were there nutritional deficiency issues at play but also that the bad food service meant there was a higher risk of riots inside the prison, putting him at risk of bodily harm.

Taylor referenced one day in particular that a riot nearly broke out: when the waffles ran out. The prisoners became agitated and said that they would not move until waffles were served. Taylor claimed that he wanted to leave the line but was told by other prisoners that leaving would make him a “sell-out.”

However, U.S. District Judge Paul Maloney wasn’t convinced.

“Plaintiff alleges only one occasion on which the food substitutions caused prisoners to become obstreperous. On that occasion, prison guards were available and were fully able to calm the situation by handcuffing a few agitators before anything more than angry comments were made,” the judge said, reports MLive.

“While the situation may have been tense, Plaintiff fails to allege facts supporting his claim that he reasonably remains at substantial risk of serious injury from last-minute food substitutions.”
