On Wednesday, 50 Cent, real name Curtis Jackson III, filed in bankruptcy court, charging Ross with using his iconic song to try to sell his new album, Black Market.
“‘In Da Club’ is an iconic song that enhanced Jackson’s fame and fueled the celebrity status he holds today,” the suit alleges.
The suit claims that Ross altered the original song “by removing some but not all of Jackson’s lyrics and performance, and then adding (his) own lyrics and performance,” but that the new Ross version is little more than “a blatant commercial advertisement for ‘Black Market.'” At one point, the song’s lyrics are changed to say, “‘Only on the Black Market, December 4th, the album is out.'”
Jackson is now seeking $2 million in damages from the “false and misleading promotional advertising campaign.”
“Defendant’s usurpation of Jackson’s identity has caused and will continue to cause irreparable harm to Jackson that cannot be fully compensated by money,” the suit says.
It is worth noting that Jackson was ordered to pay millions to Ross’ ex-girlfriend following a sex tape lawsuit which concluded over the summer.
