Patrick Newbern was charged with violating a noise ordinance and then with fleeing by vehicle and resisting arrest, though the video of his arrest shows Newbern was not even given the chance to unbuckle his seat belt when cops asked him to get out of the car.

The video shows a police officer telling Newbern to stay put while he is written up for a noise violation, but his car begins to move away, and a police officer is heard shouting, “Get his ass out of the car.” Newbern then explains that his brakes don’t work, at which point he is pulled out of his car before he can get out of his seat belt.

He can be heard screaming in agony as he is pepper-sprayed, then screaming, “I can’t see!” He can also be heard saying, “I ain’t resisting, bro!” The crowd around the scene also takes up the cry.

Tony Hollis, president of the Mississippi County Chapter of the NAACP, said the NAACP was pressing for an investigation, saying, “As soon as I saw the video, it made me sick to my stomach.”
