Justice Ruth Bader Ginsburg thinks that Colin Kaepernick’s protest of the national anthem is “dumb,” but she “wouldn’t lock a person up for doing it.”

While promoting her book, “My Own Words,” to Yahoo’s Katie Couric, Ginsburg spoke about the protests led by Kaepernick, who refused to stand during the national anthem.

Ginsburg called the protests “dumb and disrespectful,” saying, “I would have the same answer if you asked me about flag burning. I think it’s a terrible thing to do, but I wouldn’t lock a person up for doing it. I would point out how ridiculous it seems to me to do such an act.”

But, she added, there was no law against their protests, and those that participated should not be punished for doing so.

“if they want to be stupid, there’s no law that should be preventive. If they want to be arrogant, there’s no law that prevents them from that. What I would do is strongly take issue with the point of view that they are expressing when they do that,” she said.

Asked about the presidential election, Ginsburg said that the rhetoric being thrown around was “distressing” but said that she was “hopeful it will go away.”
