Loving and her friend, Adrianna Green, were walking past the home of their white neighbor on March 5 when they called 911 for help after the man reportedly threatened to shoot them, brandished a weapon and said he would shoot the “burnt black-ass face” off.

A terrified Loving called the cops for help but was violently thrown to the ground and charged with resisting arrest and disorderly conduct/disturbing.

“It hurt to talk for three days,” said Loving who says she has bruises. “The officer should be trained in empathy. I got treated like trash.”

Her lawyers said she’s suing the Miami Dade Police Department in federal court, reports The Miami New Times.

“Dyma’s lawsuit against these parties, both collectively and individually, addresses the complete and total breakdown of the officers’ inability to serve and protect her properly,” her lawyers, Justin Moore, Kyara Herard, and Christina Roye said this morning in a media release.

Officers Alejandro Giraldo and J.F. Calderon are named in the suit and are being accused of false arrest, false imprisonment, malicious prosecution, negligent hiring, negligent training and supervision, excessive force, battery, and deprivation of Loving’s civil rights.

The police director Juan J. Perez after viewing the video condemned the officer’s actions.

“I find the actions depicted on the video deeply troubling and in no way reflective of our core values of integrity, respect, service, and fairness,” he said. “This is why last week, upon becoming aware of the video posted on social media, an immediate inquiry was initiated which resulted in the involved officer being relieved of duty and of his role as a field training officer. An investigation into the entire incident is currently ongoing and I upon its conclusion, I will hold those that violated any of our policies and/or procedures accountable for their actions or lack thereof.”

Loving’s friend Green captured the confrontation on video where Officer Alejandro Giraldo can be seen lunging at Loving and pushing her up against a fence.

“Do not touch me!” Loving can be heard yelling.

Giraldo put Loving in a chokehold and wrestled her to the ground.

Giraldo also reportedly told Loving he would have her committed to a mental institution.

“She needs to be corrected if anything,” one of the cops said on film.

“Why do I have to be corrected when my life was just threatened?” Loving responded. That’s when a cop reportedly tackled her.

The neighbor, Frank Tumm, a white man, wasn’t arrested until March 14. He now faces two counts of aggravated assault with a deadly weapon.

Additionally, Loving is requesting that State Attorney Katherine Fernandez Rundle‘s office file charges against the overzealous cops.

“It is important to note that while pursuing prosecution of Dyma’s civil claims against these state agencies and the officers who aggrieved her is important, this will not take the place of criminal prosecution by the State Attorney’s Office,” Loving’s lawyers said today.

“Thusly, we renew our pleas for the State Attorney to fulfill the duty of seeking equal justice for all people in the Miami-Dade area without condition, and we further our pleas that these two officers’ positions at the police department be vacated immediately.”
