The woman who accused Derrick Rose and two of his friends of rape has filed for an appeal on Thursday.
The woman who accused Derrick Rose and two of his friends of rape has filed for an appeal on Thursday. She argues that damning testimony in the trial should not have been included and that other evidence should have been admitted.
“We combed the records, looked at the transcripts and I think the judge misapplied the rape shield law and, in doing so, abused his discretion,” her lawyer, Waukeen McCoy, told The Associated Press.
Rape shield laws prohibit evidence of past sexual history from being presented during rape cases. During the trial, Rose and his two friends testified that the woman had consented to have sex with them earlier in the evening.

The woman claimed that she felt drugged and that she was incapable of consenting to sex. She claimed that she woke up in the early hours of the morning to find that the three men were assaulting her. However, jurors ultimately found that they did not feel there was enough evidence to back up her claims.
Since the court found Rose and his friends not guilty, Rose and his legal team have filed suit against the woman demanding that she pay $70,000 in damages for sullying his reputation and the reputation of his friends.
