A jury in Dallas will decide whether a man convicted in the fatal shooting of a police officer who was serving a warrant should spend the rest of his life in prison.

Deliberations will resume Monday in the penalty phase for Charles Payne.

Payne was charged with capital murder in the 2009 death of Sr. Cpl. Norm Smith. Jurors on Friday convicted Payne of the lesser charge of murder and then started the punishment phase.

Jurors began penalty deliberations Saturday, but had Sunday off.

Payne testified he thought he was being robbed and did not know that the people outside the door of his apartment were police, looking for another man inside the unit.

The jury heard from Smith’s daughter on Friday, while Payne’s family and friends took the stand Saturday.

The jury deliberated sentencing for about an hour before the judge dismissed them.
