The grievance was filed by the police union on Wednesday following the news that Tensing would be charged with murder and manslaughter for the death of Samuel DuBose. Tensing lost his job when the charges were announced.
Catherine Brockton, the union’s executive director, said that she knows Tensing will not be able to get his job back while he is under investigation but continue on to say that the union would fight to get Tensing his job back if he’s found not guilty, even if the department does not want to reinstate him.
“He hasn’t been convicted of anything,” Brockton said.
Brockton described the grievance filing as routine, but it is part of a larger issue facing police departments that are trying to discipline their officers. For example, in December, the Warren, Michigan, police department were forced by an arbiter to reinstate and officer who had been caught on camera forcibly cutting off a woman’s hair, despite the fact that the police department did not want that officer back on the force. This over the city’s statement that it “strongly” disagreed with the decision.
