According to CBS Chicago, an unidentified officer responded to a domestic disturbance call in which a 911 caller said that LeGrier was a “little agitated” with a baseball bat. It is not yet clear what prompted the officer to fire during the response, but that action left not only LeGrier but also 55-year-old grandmother Bettie Jones dead.

To make matters worse, Antonio LeGrier said he was forced to leave behind “his dying son and family” in order to talk to detectives even as his son lay dying in the foyer.

The lawsuit, filed in the Circuit Court of Cook County, disputes the police description of LeGrier as a “combative subject” and insists that LeGrier was unarmed when he was shot down.

“It’s a particularly egregious situation,” said Basileios Foutris, a Chicago attorney representing LeGrier’s family. “He didn’t have a weapon, no knife, no gun.”

The lawsuit does not mention Jones, and it is still unclear how she wound up in the line of fire. Her pastor at New Mount Pilgrim Missionary Baptist Church said she was likely just trying to help.

Jones’ daughters told NBC News she was merely answering the door when police shot and killed her.
