Baby suffers nerve damage during birth, family says doctor was drunk

Alex Sims is suing the doctor who delivered her son, Jared, in May of 2015, claiming that he was drunk when he delivered the baby and caused nerve damage to her son’s arm.

Jared now has Erb’s Palsy, meaning he suffers from paralysis to his arm because of the nerve damage.

The doctor, Frank DeLee, was caught on camera openly talking about having been drinking during happy hour before he came to deliver the baby. He was on-call, and Sims’ doctor was on vacation when he got the call to deliver Sims’ son.

In the video, DeLee can be heard saying, “Wasn’t that many people in the bar when I left” and talking about having to waste tequila to come to the birth.

Sims’ mother, Sheree, said that she noticed DeLee smelled like alcohol the moment he arrived: “That’s what preceded the conversation about him coming from the bar. Because I said, ‘Oh, he smells like alcohol.'”

In addition to the doctor, the nurses and staff at Sunrise Hospital have been named in the lawsuit, as Sims claims they should have prevented the drunk doctor from going through with the procedure when he was clearly too impaired to do so.
