Ruiz has reportedly offered to sell Miller the tape for $2.5 million rather than release it, according to court documents. While Miller is referred to as “Doe” in the documents, news outlets have reported that it is Miller facing the release of a sex tape from Ruiz.

The tape reportedly dates back to June when Miller was on vacation with several friends in Cancun, Mexico. He rented out a house for his friends to stay in along with Ruiz and several other women.

At the time the tape was recorded, Miller allegedly knew that Ruiz was recording but requested that she keep the tape private. Later, he asked her to delete the video altogether, and she replied, “Gotcha,” to the request. However, she then went on to threaten its release, reportedly because she wanted to become “the next Kim Kardashian.”

In order to prevent the tape’s release, a judge released a temporary restraining order on Ruiz to prevent her from making copies of the tape, and Miller has petitioned as of last week to ban Ruiz from “selling or commercially exploiting the tape,” claiming it would damage his appeal to “many different people from virtually all walks of life including families and children.”

Prior to the restraining order, Ruiz reportedly tried to sell the tape to TMZ and a “sex tape broker.”
