Bill Cosby’s lawyers filed legal documents wanting to present evidence that Andrea Constand, the woman accusing him of sexual assault, was gay.
The suggestion by the defense was that Cosby would not have wanted to have sex with Constand if he had known she was gay, though the prosecution fought back against the defense by claiming that the idea of bringing up Constand’s sexuality was “victim shaming.” What’s more, it violated Pennsylvania law that prohibited a victim’s sexual past from being used in cases like this.
But as TMZ reported, it may actually be a good thing for Cosby that a judge denied the defense motion, because if the defense had argued that Constand was gay and was not interested in men, Cosby’s own argument that the sexual conduct was consensual would be destroyed.
Constand herself told police that she had a boyfriend at age 14 and had sexual contact with a man while she was in her 20s.
The sexual assault case against Cosby is now entering its fifth day, in which the court is expected to focus on Cosby’s own testimony in which he admitted that he gave women quaaludes to dull their senses.
