Following the murder of NYPD Detective Randolph Holder, a Manhattan gun case is in jeopardy, because the detective was a key witness in the case.

According to NY Daily News, a lawyer for 26-year-old Brandon Waters claimed that Holder’s death meant the case had “changed significantly” and subsequently asked for a reduction in bail for Waters, who was accused of trying to get rid of a loaded rifle in the presence of the police and who is considered a “violent predicate felony offender.”

Gurmeet Singh of the Legal Aid Society continued on to say that “it’s a terrible tragedy what happened to the arresting officer in this case,” but that the prosecutor “going to have meetings with some of her superiors about whether or not this could even go to trial.”

Singh added that Holder “was a major witness here that, again, now we will not have the opportunity to cross-examine.”

In arguing for a reduction in the set bail from $100,000 to $25,000, Singh argued that “the case has changed significantly since when this was arraigned back in October of last year.”

Justice Charles Solomon has reserved his decision concerning the bail amount until the pre-trial problems are addressed. “If they’re not going forward with the hearing, no point in arguing bail. He will be released, I guess, if they can’t make out their burden,” he said.
