The lawsuit identified the woman as Jane Doe and she is suing for sexual battery, assault, and false Imprisonment, The Wrap reported Tuesday. The woman claims that the incident took place on June 23 around 2:30 a.m. and that she’s “suffered and continues to suffer economic damages, as well as severe emotional and physical harm, humiliation, distress, embarrassment, and anxiety as a result of Takeoff’s conduct.”
According to the legal documents, the woman caught the rapper’s attention while the two were at a Los Angeles party and that he made her “extremely uncomfortable” by staring at her. Takeoff, born Kirshnik Khari Ball, even offered her weed as the night progressed but she refused him.
The Wrap further reports that Jane Doe told DJ Durel, Migos’ official DJ and the man who invited her to the party, that she wasn’t interested in Takeoff. Offset and Quavo are the other two members of the popular Atlanta trio known for hits such as “Stir Fry.”
“She had no desire to engage in any sort of intimate relationship with Defendant Takeoff, and that Defendant Takeoff made her uncomfortable,” the suit contends.
The suit further claims that Jane Doe was going upstairs with Durel, whose real name is Daryl McPherson, and Takeoff got angry. The rapper and Durel then began to argue and the woman decided to go into another room until the confrontation died down.
According to the lawsuit, Takeoff followed her into the room and began touching her butt. She claims she once again refused his advances. She then alleges that Takeoff flipped her over, pulled down her clothes and raped her.
“Shortly thereafter, the door of the bedroom opened, and Defendant Takeoff walked in. Defendant Takeoff began touching Plaintiff’s buttocks. Plaintiff clearly and unequivocally refused Defendant Takeoff’s advances and stated to Defendant Takeoff that she did not want to have sex with him. Notwithstanding Plaintiff’s express refusal, Defendant Takeoff grabbed Plaintiff, flipped her over face-down, and pulled down her clothing,” the suit detailed.
“Defendant Takeoff then proceeded to have forceful sexual intercourse with Plaintiff from behind, without Plaintiff’s consent. After Defendant Takeoff finished raping Plaintiff, he immediately left the room,” the suit said.
Jane Doe was in shock and ultimately went to a nearby hospital. Officials at the hospital “observed physical evidence of forceful rape and notified the Los Angeles Police Department of the same.”
