Back in 2008, the Chicago Police Department investigated a sexual assault claim against R. Kelly, which resulted in no criminal charges being filed against the embattled singer.

The alleged crime happened outside of the statute of limitations, according to records about the incident. The victim reported that the incident occurred at Kelly’s infamous recording studio back on July 1, 2008, The Chicago-Sun Times reports.

That means the alleged sexual abuse occurred less than three weeks after Kelly was acquitted on child pornography charges, according to the outlet.

The Chicago Police Department denied a request to release records in regards to the 2008, that the Sun-Times requested through a Freedom of Information Act request.

The Chicago PD said because of an on-going investigation, they have denied the request on Monday.

“While responsive records were identified, disclosing these records would adversely impact an ongoing Chicago Police Department investigation,” CPD officials said in the denial letter.

They did confirm that the records they are withholding pertain to a “high profile offender Robert Kelly who is known as R. Kelly.”

On Tuesday, Chicago police spokesman Anthony Guglielmi said the allegation did undergo an investigation but they could not prosecute because it was beyond the statute of limitations for prosecution.

Kelly has been charged with 10 counts of aggravated criminal sexual abuse for sexually abusing 4 people, including 3 minors.
