Man's lawsuit against Ferguson police for wrongful arrest, assault reinstated

A Missouri man has won the appeal to get his lawsuit reinstated against the Ferguson Police Department.

Henry Davis claims he was mistaken for a criminal and severely beaten by officers back in 2009. He was then charged for destruction of property for bleeding on officers’ uniforms.

The case was halted by a judge who said the injuries were not severe enough, despite a gruesome photo of Davis showing him bleeding from the top of his head down.

During the incident, Davis was arrested for speeding and also allegedly for being intoxicated.

Davis said that he was arrested and beaten  “without provocation while he was handcuffed on the ground” after the police mistook him for another Henry Davis.

Officers claimed that Davis was drunk and had in fact started the fight himself.

It has been six years since the incident, which occurred long before Ferguson became known for the death of Michael Brown and the troublesome relationship between its police department and residents of color.
